I recently posted a warning about fake “Department of Justice(DOJ)” cards that appeared to exempt people from having to wear masks. These bogus cards also claimed that their holders were exempt from wearing masks as a reasonable accommodation under the Americans with Disabilities Act (ADA).
As I and others have written, this is a misrepresentation of the DOJ, the ADA and the concept of reasonable accommodation. However, it should not drown out the fact that there are some disabilities where wearing a mask would, in fact, be unsafe. In those limited circumstances, both emp
loyers and businesses should strive to make an exception to their “no masks” policies, if this can be done without an undue hardship.
